Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of himbos.com and any waitlist, referral, checkout, or Founding Himbo membership service offered by Himbos Inc., a Delaware corporation (“HIMBOS,” “we,” “us,” or “our”). By using the site or purchasing an offer, you agree to these Terms.
1. Eligibility and accounts
You must have legal capacity to enter a binding agreement. If local law considers you a minor, a parent or guardian must authorize your use. You agree to provide accurate, current information and not misuse another person’s email, payment method, or identity.
2. The Founding Himbo offer
Unless checkout clearly states otherwise, the Founding Himbo offer is a one-time US $1 payment for lifetime Founding Himbo status. It is not a subscription and does not renew. Paid public membership numbers are sequentially allocated from #0100 through #50000, subject to successful payment, availability, fraud review, and these Terms. Reserved or ceremonial numbers follow separate allocation rules.
“Lifetime” describes non-expiring membership status rather than a subscription. It does not guarantee that every described benefit, product, or website feature will remain unchanged or continuously available. Membership status has no cash value, is not an investment or ownership interest, and may not be sold or transferred without our written permission.
3. Benefits and product availability
Described benefits may include a badge, early access, updates, or opportunities to help shape the brand. Benefits may evolve, have separate eligibility rules, or be unavailable in some locations. Membership does not guarantee free physical products, inventory, shipping, a particular product launch, or a financial return.
4. Payments, taxes, and refunds
Stripe processes checkout. You authorize the displayed one-time charge and represent that you may use the selected payment method. Applicable taxes may be added where required. Refund rights, if any, follow applicable law and any checkout-specific policy shown before payment.
If payment is reversed, disputed, fraudulent, or made in error, we may suspend the related status while investigating. A revoked or refunded membership number is not recycled.
5. Waitlists, marketing, and referrals
A waitlist entry does not guarantee access, pricing, inventory, or membership. Marketing is optional and requires a separate consent. Submitting a friend’s email records an invitation attribution only: it does not enroll, subscribe, or email that person through the current referral feature. You may submit a referral only when you have a legitimate reason to believe the person would welcome it.
6. Acceptable use
You may not:
- Break the law, infringe rights, harass others, or submit deceptive or unauthorized information.
- Probe, disrupt, overload, scrape, reverse engineer, or bypass the site’s security or access controls.
- Use bots or multiple identities to manipulate waitlists, referrals, analytics, checkout, or member-number allocation.
- Copy, resell, impersonate, or falsely imply endorsement by HIMBOS.
7. Intellectual property
The site, brand, product imagery, copy, graphics, software, and related materials are owned by HIMBOS or its licensors and protected by intellectual-property law. We grant you a limited, revocable, non-transferable right to use the site for its intended personal purpose. No other license is granted.
8. Third-party services and links
The site relies on services such as Stripe, Supabase, Resend, Vercel, Google, and, if enabled, Microsoft Clarity. Their services may be governed by their own terms and privacy notices. We are not responsible for independent third-party sites or services outside our control.
9. Disclaimers
To the maximum extent permitted by law, the site and pre-launch services are provided “as is” and “as available.” We do not promise uninterrupted access, error-free operation, or that preliminary descriptions will become final products. Nothing on this site is medical advice. Product-specific directions, warnings, and claims will govern any future product use.
10. Limitation of liability
To the maximum extent permitted by law, HIMBOS and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, or lost data arising from the site or services. Our total liability for a claim relating to the Founding Himbo offer will not exceed the greater of the amount you paid us for that offer or the minimum amount required by applicable law. Some jurisdictions do not allow certain exclusions, so they may not apply to you.
11. Suspension and termination
We may restrict access for fraud, abuse, unlawful conduct, security risk, or material breach of these Terms. Provisions that by their nature should survive will remain in effect after termination.
12. Changes
We may update these Terms as our services change. We will post the revised effective date and provide additional notice when required. Continued use after revised Terms take effect constitutes acceptance where permitted by law.
13. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Mandatory consumer protections in your place of residence remain applicable where they cannot lawfully be waived.
14. Disputes and venue
Before filing a legal claim, please send a written description of the dispute to hi@himbos.com so the parties can attempt to resolve it informally. Unless applicable law requires otherwise, the state and federal courts located in Delaware will have exclusive jurisdiction and venue over disputes arising from these Terms or the HIMBOS services. Each party consents to those courts’ jurisdiction.
